  • An employer-employee meeting will not satisfy Step 2 of the (now repealed) statutory dismissal procedures where the decision to dismiss the employee is taken in advance of that meeting.
  • Where one incident in an employee's record is effectively "double-counted" in their redundancy selection assessment by the employee being marked-down in two separate criteria for the same incident, the selection procedure is unfair.
