Carmelli Bakeries Ltd v Benali - gross misconduct was not 'operative cause of dismissal', but still contributed to it
In a case of unfair dismissal where the employee was guilty of gross misconduct which contributed to the dismissal, albeit it was not "the operative cause" of it (in this case, victimisation was) a tribunal should still consider whether it is appropriate to reduce compensation due to contributory conduct.
