Carpenter v City of Edinburgh Council - Delay, the right to a fair trial, and blots on the landscape [2008] EAT
Mr Carpenter brought claims of disability discrimination and unfair dismissal. They were heard by an employment tribunal between November 2001 and March 2004. The decision was eventually promulgated on 5 April 2007. Mr Carpenter lost. He appealed. He argued that important social issues in his case had simply been lost sight of due to the delay.
