Central & North West London NHS Mental Health Trust v Amara - tribunal's findings about employer's investigation were neither wrong nor perverse - EAT 16.4.08
Mr Amara, a nurse at a mental hospital, was dismissed after a seriously ill patient alleged that Mr Amara had taken him to his home to smoke crack. An employment tribunal found the dismissal unfair - in particular the Trust's investigation and subsequent disciplinary process (where it had not followed its own procedures) had not been within the band of reasonable responses. The Trust appealed.
