Centrica Storage Ltd (1) Lewis Silkin LLP (2) v Tennison - Tribunal acted within its discretion in refusing late amendment to withdraw concession of disability [2008] EAT
Mr Tennison brought claims of unfair dismissal and disability discrimination. On exchange of witness statements, Centrica sought to amend its Response to the claim to withdraw an admission it had made that Mr Tennison was disabled. At the first day of the scheduled hearing the employment tribunal refused it leave. It also ordered Lewis Silkin, Centrica's solicitors, to pay the wasted costs of the aborted hearing. Centrica and Lewis Silkin appealed.
