Chelsea Football Club Plc v Smith - distinction drawn on admissibility of evidence was perverse - EAT 26.6.08

Mr Smith's claimed unfair dismissal and unlawful deductions from wages.This case involved an appeal against case managements orders made by an Employment Judge in advance of the substantive hearing. The Employment Judge ruled that parts of Mr Smith's witness evidence were inadmissible, as was all of his partner's statement, and that parts of the case should be heard in private due to confidentiality. Both sides appealed to the EAT against elements of these orders.
