Chenembo v London Borough Of Lambeth - Reasonable adjustments for possible disability [2010] EAT

Disability issue need not be determined because there was no substantial disadvantage in any case.

Following her resignation on 7th September 2010 and the dismissal of all of her claims including constructive dismissal, Ms Chenembo, after a number of hoops ably jumped through, bought the remaining elements of her case before an EAT panel led by HHJ Peter Clark. She claimed that her employer, London Borough of Lambeth, had failed to make reasonable adjustments in light of her disability. Lambeth contested that she was disabled. The EAT found the issue of whether she was disabled to be moot because the facts showed that Lambeth had not failed to make reasonable adjustments in any case.
