Cheshire & Wirral Partnership NHS Trust v Abbot & Others - Equal Pay, justification and choice of comparators [2005] EAT

The EAT appears to accept without question that the material factor defence under Equal Pay Act 1970 s.1(3) requires that the difference in pay between men and women is based on factors unrelated to any discrimination on the grounds of sex which can be objectively justified (this judgment came before those in Sharp v Caledonia Group Services and Armstrong v Newcastle upon Tyne NHS Hospital Trust).
