Chivas Brothers Ltd v Robertson - errors and contradictions made tribunal judgment unreliable
There were too many errors and contradictions in an employment tribunal's judgment to satisfy the EAT that it was reliable.
Mrs Robertson was an administrator at the Chivas bottling plant. She was dismissed for gross misconduct - Chivas found that she had been responsible for it incurring excess expenditure on stocks of consumables where the items were never recorded as entering stock, were not supported by business use, and there was no authority for the excess spending.
