City of Edinburgh Council v Wood - Tribunal substituted its own view rather than considering range of reasonable responses [2008] EAT
After a period of dissatisfaction when he had put in a grievance, Mr Wood was disciplined for gross misconduct in the form of abusive comments and, as a penalty, moved to work at a different establishment. He resigned claiming constructive unfair dismissal, citing the Council's failure to properly deal with his grievance and then moving his as the fundamental breaches. An employment tribunal agreed that he had been unfairly dismissed and the Council appealed.
