Clearsprings Management Ltd v Ankers & Others - service provision was too "fragmented" to trigger TUPE transfer [2009] EAT

Mrs Ankers and 16 others worked for Clearsprings who, in 2000, won a contract to provide services for the National Asylum Seekers Service (NASS) supporting asylum seekers (Service Users - "SUs"). In 2006 new contracts were awarded, and Clearsprings failed to secure one, losing out to UPM, Priority and Happy Homes. The SUs that Clearsprings had been supporting were randomly distributed among these three companies.
