Clydeport Ltd v (1) Sinnamon (2) Gilchrist - Unreasonable failure to follow collective agreement made redundancy dismissals unfair [2007] EAT

Clydeport Ltd made port operatives Mr Sinnamon and Mr Gilchrist redundant. A collective agreement was in place for redundancy situations, but Management did not follow its terms. An employment tribunal held that doing so may have altered the outcome of the selection, and so the dismissals were unfair. Clydeport appealed.
