Commissioner of Police of the Metropolis v Virdi - Fundamental mistake of fact completely undermined tribunal's reasoning in finding victimisation  EAT
When Detective Sergeant Virdi's application for promotion failed he brought employment tribunal proceedings against the Met. His claim that the promotion panel's decision was direct race discrimination failed, but he also alleged victimisation, based on having previously (and successfully) brought a race discrimination claim which had been high profile and led to an inquiry which was very critical of the police. The employment tribunal upheld the victimisation complaint. The Metroplitan Police appealed.
