Community Integrated Care Ltd v Smith - an employee's admission of wrongdoing limits the need for investigation by an employer prior to dismissal - EAT 23.9.08

Miss Smith was dismissed for abusing a patient by using foul language. A number of her colleagues confirmed that Miss Smith used foul language, and Miss Smith herself admitted, at the disciplinary hearing, that she had indeed spoken to the patient in question as alleged. An employment tribunal concluded, by majority with the employment judge dissenting, that the dismissal was unfair, due to an inadequate investigation. CIC appealed.
