Compass Group UK and Ireland Ltd T/A Scolarest Educational Food Service v Wilson - EAT 26.4.07

An employment tribunal rejected Compass Group's response to claims by Mr Wilson as it was out of time. On review a Chairman refused to change this, without giving adequate reasons, even though supplied with "a fairly substantial quantity of documentation ... from which it was apparent that there was a very real defence on the merits". The EAT has now allowed an appeal pointing out that the purpose of the sanction is not punishment but is to achieve the overriding objective of dealing with cases justly.
