Computers in the City Ltd v Martin - Tribunal failed to fully address case [2011] EAT

An employment tribunal must always fully address and deal with the case argued by the parties during the hearing and in its subsequent judgement.

Mr Martin, an executive employed by Computers in the City Ltd (CCL), was off sick. Whilst accessing material they needed on his computer, CCL found non-work related documents there. Further investigation revealed he was also working for another company in the financial sector, PI Global Partners Limited, (PIG). He had clearly done work for PIG, which was not in competition with CCL, during CCL's work-time. When confronted Mr Martin denied this, until shown that the PIG website described him as one of their business analysts. CCL summarily dismissed him
