Conduct as a Reason
- Conduct is one of the potentially fair reasons for dismissal
- In order to be a fair dismissal, the employer must have a reasonable and genuine belief that the employee committed the act of misconduct, based on a reasonable investigation
- The core principles of reasonable behaviour are set out in the ACAS Code of Practice
- The tribunals will take the ACAS Code of Practice into account and may also consider the Guide when considering the range of reasonable responses by a reasonable employer
