Cordell v DHL Exel Europe Ltd - If a claimant chooses to jump the gun by withdrawing an appeal, that is his own fault - [2008] EAT

Mr Cordell lost unfair dismissal and wrongful dismissal claims. His appeal was rejected on the sift. He then sought an oral hearing but before that was heard applied for the appeal to be withdrawn. The Registrar then made an order dismissing the appeal. He now claimed that he had made that application on the incorrect understanding that his former employer had agreed to accept liability. That turned out not to be the case and he sought to have the appeal reinstated.
