Corus UK Ltd v A M Mainwaring - Advice from consultant need not be sought in malingering case [2007] EAT
Corus received information that Mr Mainwaring was only pretending that he was unfit for work. They arranged surveillance and obtained video footage supporting this. Following suspension and consultation with their occupational health adviser, Corus dismissed Mr Mainwaring. The Employment Tribunal found that the dismissal was unfair. Corus appealed.
