Cumbria County Council & Anor v Bates - post-dismissal conduct and compensation for unfair dismissal

In certain circumstances post-dismissal conduct (such as conviction and imprisonment which could impact future employability) can be taken into account when considering the compensatory award for unfair dismissal.

Mr Bates was a teacher, who in April 2009 was dismissed. In September 2010 an employment tribunal ruled that his dismissal was unfair, and a remedies hearing was listed for February 2011.
