Cumbria County Council v Dow & others (2) - Equal pay time limits dependent on whether variation or termination of contract [2007] EAT

The Equal Pay Act 1970 requires a claim to be brought within 6 months of the termination of the contract in which the inequality is alleged to have occured. Many of the council workers bringing these equal pay claims had had changes in their roles and hours recorded in purported new "contracts of employment". A discreet issue, therefore, was whether the claims were in time - this depended on whether contracts had been terminated (and replaced) or simply varied.
