Czikai v Freemantle Media Ltd & Others - No disability discrimination against Britain's Got Talent contestant [2011] EAT

Matters of case management and findings of fact are for an employment judge to resolve in the circumstances and on the evidence before them. A contestant in a TV talent show is not in an employment relationship with either the shows producers nor the judges on that show, and cannot bring a discrimination claim against them in an employment tribunal. 

Ms Czikai took part in Britain's Got Talent, but her audition was not a success. She attributed this to her medical condition fibromyalgia, and brought employment tribunal claims complaining that reasonable adjustments had not been made for her performance on the night in question, and that publication of her performance on media such as YouTube amounted to harassment on grounds of disability.
