Da Silva v Composite Mouldings & Design Ltd - a wide definition is to be given to the expression "associated employers" for continuity of employment purposes - EAT 18.8.08

Mr Da Silva claimed his dismissal was automatically unfair for failure to follow statutory procedures. However his employer, Composite, argued that he did not have the requisite 12 months continuous employment to enable him to bring his claim. Composite argued that Mr Da Silva's continuous employment started 14 months later than he claimed since before then he had been employed by a different company (Andream) that was in liquidation.
