Daleside Nursing Home Ltd v Mathew - lies and costs
Where a failed claim is based on a lie it is perverse for an employment tribunal to refuse to award at least some costs
An employment tribunal Tribunal dismissed claims by Mrs Mathew against Daleside Nursing Home Ltd, her employer, for direct race discrimination, constructive unfair dismissal and unlawful deduction of wages. Daleside then applied for a costs order against Mrs Mathew. This application was rejected by the employment tribunal and Daleside appealed to the EAT.
