Davis v Pyrz - Unlawful deductions from wages [2007] EAT
In this case the EAT dealt with an appeal by a Miss Davis, whose former nanny, a lady from Poland named Miss Pyrz, had been awarded £2,832.90 for a claim for the National Minimum Wage as well as just over £400 for holiday pay. The main point now at issue was whether Miss Pyrz was entitled to reclaim the sum of £200 which had been deducted from her wages in instalments to be held as a deposit, with her full consent. An employment tribunal ruled that this had been an 'unlawful' deduction from wages because consent had not been given in writing.
