Dennison v University College of St Mark and St John & ors - Part-time pensions case [2006] EAT

The Exeter Employment Tribunal found that Mrs Dennisons’s claim for retrospective membership of the local government superannuation scheme failed. She did not join the scheme for some eight years after having become eligible. Her claim that this was because she had taken out a private pension was rejected. She alleged that the Tribunal had failed to ask the fundamental question whether she would have joined earlier had she been eligible and had simply focused on whether her reason for not joining was that she had a private pension.
