Diem v Crystal Services plc - Fair Hearing and Appearance of bias [2005] EAT

A Vietnamese woman brought complaints of unfair dismissal, race discrimination and victimisation against her former employer. Her claims were dismissed by an employment tribunal. She appealed to the EAT on the basis that the tribunal appeared to be biased against her. The tribunal chairman had made comments to the effect that her skin colour was white, indeed whiter than his.
