Digby v. East Cambridgeshire District Council - Reasonableness of dismissal and admissibility of evidence [2006] EAT
Mr Digby, a planning officer for East Cambridgeshire District Council, took his employers to a tribunal, claiming unfair dismissal. This appeal concerned whether the tribunal was (i) entitled to exclude evidence relating to Mr Digby's final warning and (ii) correct to do so. The EAT decided that the tribunal did have that discretion but that in this case by exercising that discretion it "was effectively preventing the Claimant from advancing his case of unfair dismissal."
