Dorset County Council v Omenaca-Labarta - Fixed-term nature of position can be a factor in justifying less favourable treatment of part-timer [2008] EAT

Due to falling numbers, the school where Mr Labarta worked as a part-time supply teacher had to lose "0.6 of a teacher" - and since this matched Mr Labarta's hours his fixed term contract was not renewed. The school looked no further than Mr Labarta, who obviously fitted its need perfectly. It did not consider, for example, dismissing another teacher and increasing Mr Labarta's hours.
