Drewett v Penfold - how a tribunal should exercise its discretion to apply an uplift to unfair dismissal compensatory award

The discretionary power of an employment tribunal to order an uplift in the amount of compensation payable to a successful claimant if the employer failed to comply with proper disciplinary procedures is a limited discretion (at any rate under pre-April 2009 rules) in that it entitles the tribunal to take account of the whole circumstances surrounding the failure but does not allow it to take account of other extraneous circumstances.
