D'Silva v Manchester Metropolitan University - adjournment of hearing on medical grounds

When deciding whether or not to adjourn a hearing on medical grounds the Employment Tribunal is entitled to be satisfied that the inability of the litigant to be present is genuine. Lack of representation will not necessarily mean the Tribunal will adjourn proceedings either - there is no 'one size fits all' approach on fairness.
