D'Silva v NATFHE (University & College Union) & others - Failure to answer statutory questionnaire does not automatically create inference of discrimination [2008] EAT
University lecturer Dr D'Silva was a member of the union NATFHE. He claimed that the union had discrimnated against him on grounds of race in the way it handled his applications to it for legal assistance in bringing discrimination claims against Manchester Metroplitan University. An employment tribunal dismissed Dr D'Silva's complaints. He appealed to the EAT. His appeal included a claim that the tribunal had not considered whether it should draw inferences of discrimination from the alleged failure of the union to fully answer a statutory questionnaire.
