Duffy v George - not attendance of claimant does not prevent tribunal making findings adverse to respondent
EAT judgment headnote reads:
A Tribunal does not necessarily err in law if it proceeds with a hearing and makes findings of fact adverse to a respondent where a claimant does not attend and is not available for cross examination.
Rules 14 and 27 of the Employment Tribunal Rules of Procedure considered.
