In March 2006 Mr Duncan lost an employment tribunal case. He was ordered to pay a contribution of £6,500 towards his employer's legal costs on the grounds that his claim had always been misconceived and that as from 21st October 2005 when a witness statement had been disclosed to him "the continued pursuit of this claim was ... not just misconceived, it was unreasonable".
