Dutt v Kingston University - Dismissal on non-attendance and re-instatement of claim on review amounts to postponement [2007] EAT

Ms Dutt sought to have her employment tribunal hearing postponed due to ill health, but this was refused. She failed to attend on the day, and her case was dismissed. She secured a review and her case was re-instated, but she was ordered to pay the University's costs for the wasted hearing, under Rule 40. Ms Dutt appealed.
