East Living Ltd v (1) Sridhar (2) TSG Services Ltd - Agency workers: Tribunal must not imply contract of employment with end-user simply because the parties' conduct could be consistent with there being such a contract [2008] EAT

Mr Sridhar was provided by TSG (an agency) to work for East, the "end-user". Mr Sridhar brought various claims of discrimination and the question arose as to who was his employer. He had no written contract with East, but he did have a detailed written contract with TSG. TSG paid him, and he was obliged to follow their procedures in respect of grievances etc. However, an employment tribunal implied a contract with the end-user, East, who appealed.
