Echendu v William Morrison Supermarkets Plc - Time for applying for oral hearing at EAT runs from date when Rule 3(7) notification of refusal of appeal is sent out [2008] EAT

An employment tribunal dismissed Mr Echendu's claims race discrimination. His appeal to the EAT was dismissed "as having no prospect of success" at the Rule 3(7) "papers sift" stage. Mr Echendu sought an oral hearing under Rule 3(10) - but his application arrived two days outside the 28 day time limit. The Registrar refused to extend time. Mr Echendu, arguing that the 28 days should run from when he received the Rule 3(7) decision, appealed against that refusal.
