Edwards v Swindon Borough Council - adequacy of reasoning in a tribunal judgment
In considering whether a Tribunal judgment is "Meek compliant" (ie complies with the guidance in Meek v City of Birmingham District Council CA [1987] IRLR 250 that it must include an outline of facts, factual conclusions and a statement of reasons demonstrating why the decision was reached) it is important to "look beyond the style to the substance". The important factors are whether the Tribunal asked the right legal questions and sufficiently explained its reasoning process.
