Enfield Technical Services Ltd v Payne - Illegality & unfair dismissal [2007] EAT
In claims for unfair dismissal, if the underlying contract of employment is illegal the claim cannot be pursued. In these two cases the issue was whether Mr Payne and Mr Grace had been continuously employed by their respective employers for more than one year, which turned on whether or not they had genuinely been employees. The original tribunals made findings on illegality against which there were appeals.
