Ezsias v North Glamorgan NHS Trust - Striking out claims [2006] EAT
The Cardiff Employment Tribunal struck out an unfair dismissal claim brought by a consultant surgeon against the North Glamorgan NHS Trust. He claimed that he had been dismissed because of "whistleblowing" rather than because of the "breakdown in relationships" which the employer gave as the reason for his dismissal. The strike out order was made on the basis that his claim had no hope of success. He appealed against it as it came after an earlier pre-hearing review on a different aspect at which the tribunal had indicated that his claim was unrealistic.
