F & C Asset Management Plc v Switalski - tribunal should clearly have agreed to a Review of its earlier decision [2008] EAT

This is the latest judgment from the Employment Appeal Tribunal in the long running saga of Gill Switalski's sex discrimination claims. This time, F&C have been more successful.

F&C's appeals were against (1) the Employment Tribunal's refusal of a Review of its previous decision, given the new significant new evidence which had come to light concerning Ms Switalski's activities (including attending job interviews while she was off sick with stress and depression); and (2) the tribunal's latest findings of sex discrimination/harassment/victimisation.
