First West Yorkshire t/a First Leeds v Haigh - Where a pension scheme allows for it, employer must consider ill-health retirement before dismissing employee for incapacity [2007] EAT

Mr Haigh was a bus driver. He suffered a suspected stroke, and DVLA rescinded his licence for a year. After 8 months sick absence First dismissed him. They did not wait for medical reports to confirm whether he was permanently incapacitated. An employment tribunal found the dismissal to be unfair. First appealed.
