Flintshire County Council & Ors v Moore & Anor - Redundancy: a proper period for consultation is essential to ensure fairness in all respects [2011] EAT

Failure to allow a proper period of time for consultation led to other procedural failings - such as a poorly thought through pool for selection and the selection criteria themselves - that caused redundancy dismissals to be unfair.

Small primary school Ysgol-y-Fron made two of its seven teachers - Ms Moore and Ms Lund - redundant. Funding problems and the need for redundancies became apparent in October 2008, and the Governors had several meetings on the subject. A meeting on 3 March 2009 determined that two posts would go, with notice being given by end of Spring term to take effect at the end of the school year.
