Flintshire County Council v Michaelides - The right question in a constructive unfair dismissal case [2008] EAT

Mr Michaelides was a security attendant at a Council hall. Following an incident one night concenring enabling members of he public to get their cars out of the car-park at teh hall, Mr Michaelides was subject to disciplinary action. This did not lead to any sanction but there was considerable delay - the incident occurred in July and Mr Michaelides was not suspended until December. Eventually, two months later still, he resigned and an employment tribunal upheld his claim of constructive unfair dismissal.
