Franks v The Governors for Churchmead CofE Voluntary Assisted School & Others - medical conditions and EAT time limits

Serious medical conditions, which impact on an appellant's ability to meet time limits, can amount to exceptional circumstances warranting an extension of time to appeal against an Order of the EAT Registrar.

Mrs Franks suffered with significant health problems, including Ménière’s Disease, dyslexia, dispraxia, and learning difficulties. She was made redundant and submitted an ET1 to an employment tribunal, but it was well out of time and was dismissed. Her application for review failed.
