G4S Justice Services (UK) LTD v Anstey & ors - TUPE and "who to sue"

Employees worked for a company which provided service to the Home Office in relation to escorting immigrants. Following a BBC documentary some had been dismissed for misconduct.

A TUPE transfer of the business then took place - and internal appeals were pending at the date of the transfer. The internal appeal was conducted by the "old employer" which decided that the claimants in this case should be reinstated. Neither the old employer nor the new employer had any work for them.
