Gavin v CRE/EHRC, Shaw v Upton (t/a Alternative Sandwiches), Kapoor v ICICI Bank UK Plc - Out of time appeals [2010] EAT

The dismissal of these three appeals against decisions of the Registrar that appeals were lodged out of time once again demonstrates the EAT's policy of applying the 42 day time limit strictly.  

The EAT Rules require the Notice of Appeal and certain prescribed supporting documents to be lodged at the EAT within 42 days of the date that the judgment being appealed was sent to the parties by the employment tribunal. These three cases, all heard together, were appeals against decisions of the EAT Registrar not to register appeals. All failed.
