General Mills (Berwick) Ltd v Glowacki - Unfair dismissal: justifying difference in treatment [2011] EAT

Even where there are two sufficiently parallel cases where an employer had dismissed in one but not the other, this will not make the dismissal unfair for disparity of treatment if the employer has offered (and the tribunal accepted) a reasonable justification for such difference in treatment.

Mr Glowacki, who serviced and repaired machines for General Mills, was dismissed for gross misconduct after serious breaches of health & safety requirements. He claimed unfair dismissal at an employment tribunal, where he won.
