Girvan v Humberside Probation Trust - appeal against strike out order allowed

An employment judge must generally consider a less draconian measure, such as an unless order, before ordering a strike out.


In February 2009, two weeks before it was due to be heard, Ms Girvan's claim for constructive unfair dismissal was struck out by an employment judge in Leeds. Her application for review of the strike out order was rejected.  She has now won an appeal against both the strike out order and refusal to review it.
