GMB Trade Union & ors. v Hughes & anor - Employee and/or office holder? [2006] EAT

Are Branch Secretaries of the GMB trade union simply office holders or do they also work under a contract of employment? An Employment Tribunal Chairman in Manchester held the latter. The EAT rejected the union’s appeal. The tribunal's conclusion was a permissible conclusion and no material error of law was identified. The EAT confirmed that having the status of "office holder" is not inconsistent with being an employee, nor vice-versa - they are not mutually exclusive.
